TERMS & CONDITIONS

1. This website is operated by Angela Smith. Where these terms and conditions use terms such as "we" "us" and "our" they refer to Angela Smith.

 2. We offer this website, including all the information, tools and services available on it, on condition that you accept these terms and conditions and associated privacy policy on our website.

3. By visiting this website and/or purchasing from us, you are deemed to have accepted these terms and conditions.

4. You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change or replace any part of these terms and conditions without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to this website, read theses terms and conditions and ensure you understand them before making a purchase.  

GENERAL CONDITIONS

 

  1. We reserve the right to refuse service to anyone, for any reason, at any time.
     

  2. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various
    networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices.

     

  3. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on this website or any other part of the service we offer on this website. 
     

  4. Headings and titles used on this website are done so for convenience only. They do not constitute any part of the terms and conditions and will not limit or otherwise affect the terms herein.
     

 

ONLINE STORE TERMS 
 

 

  1.  Our website offers a range of products and or services  for sale. Where we refer to an "item" we are referring to a single product or service available for purchase on this website.
     

  2. We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto our system. 
     

  3. While care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing. 
     

  4. Due to the handmade nature of the products listed on this website, no two pieces are ever exactly identical. 
     

  5. Measurements and sizes are an approximation and have been given as a guide only. 
     

  6. We may not be able to accept your order due to one or more of the following reasons listed below:

 

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks
 

7 When you place an order you may receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us 
 

8 Your order will only be accepted by us once your goods have been dispatched. 
 

PAYMENT AND DELIVERY 

 

  1. Payment for your orders are to be made with PayPal
     

  2. I currently only accept UK orders and do not post internationally. 
     

  3. I charge a flat rate of £3.50 for P&P. Orders totalling £60 or more qualify for free P&P. 
     

  4. Orders of listed items from this website will usually be posted out within 24 hours of receipt of order. 
     

  5. Commission orders will be sent out as soon as possible after they have been made - please allow up to six weeks. I will let you know if the time frame is greater.
     

  6. Most orders will be sent by Royal Mail first class signed for, so they can be tracked. 
     

  7. Estimated delivery time for UK signed for items is 1 - 2 days, however this could be longer due to the current global COVID-19 pandemic, so your patience at this time would be greatly appreciated.
     

  8. If your order does not arrive when you expect it too please contact me and I will help resolve the issue. Please allow a period of three weeks from your order date as most delayed items will arrive during this time. If however after this time and following investigation your package still hasn't arrived or been located I will arrange a replacement or refund. 
     

  9. Most of my earrings and other small items of jewellery will either be presented on Kraft cards or packed in small card boxes.
     

  10. Other larger items of jewellery will be sent in card jewellery boxes or carefully wrapped in packing tissue paper. 

 

ORDER CANCELLATION 
 

1 If you wish to cancel an order you have placed you must contact us immediately to ascertain whether the items have already been dispatched. Where they have been dispatched you will need to return the order to us and you will be responsible for paying the cost of returning the items. For more detailed information about our returns and refund policy please see the Refund Policy page. 

 

2 Where items have not been dispatched prior to a cancellation request we will let you know whether you are entitled to a refund or exchange, or in the case of cancelling a workshop, please see the workshops information on our Refund page. 

 

3 Where you have ordered a personalised, bespoke or time critical item ( such as a commissioned piece or a workshop e-voucher) you will not be able to cancel for a full refund. 

 

LIABILITY AND INDEMNITY 

 

1 We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website. 
 

2 You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses including legal fees arising out of any breach of any of our terms and conditions. 

 

JURISDICTION 
 

These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England and Wales.

 

ENTIRE AGREEMENT 
 

These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral. 

 

GENERAL
 

1 Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.
 

2 Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
